Prescripcion y caducidad de las acciones por terminacion del contrato de trabajo

Abstract

Esta investigación está referida al estudio de las acciones por terminación del contrato de trabajo estableci as en los artículos 168 y 510 incisos primero y segundo del Código del Trabajo chileno, las cuales se ven alcanzadas por las instituciones de la caducidad y de la prescripción, respectivamente. A través del análisis de la doctrina laboral chilena, y de los veinte últimos años de jurisprudencia judicial y administrativa, este trabajo delimita el ámbito de aplicación de las acciones señaladas en cada una de dichas normas, refiriéndose a la forma de computar sus plazos, y a la manera en que éstos se suspenden e interrumpen, detectando los principales problemas jurídicos que se han suscitado en su aplicación práctica, y sistematizando las tesis que se presentan para su solución. ABSTRACT: This investigation is refered to the study of the actions by conclusion of the employment contract, established in the articles 168 and 510 clauses firstly and second of the chilean´s Labour Code, that are reached by the institutions of the caducity and of the prescription, respectively. Across the analysis of the chilean´s labour doctrine, and of the last twenty years of judicial and administrative jurisprudence, this work delimits the ambit of application of the actions indicated in each one of that norms, refering about the way of compute their terms, and the way that they are suspended and interrupted, detecting the pincipals judicial problems that have been provoked in their practical application, and systematizing the thesis for their solution.
