Analisis comparativo entre los mecanismos de solucion de controversias de nombres de dominios en Internet existentes en Chile y Espana

Abstract

Este trabajo pretende hacer un Análisis entre los Mecanismos de Solución de Controversias de nombres de Dominios en Internet Existentes en Chile y España, en primer término se hablara de los orígenes de los nombres de dominio, señalando su funcionamiento, naturaleza, función distintiva, tipos de nombres de dominio, así como una reseña histórica de los mismos, para luego en el segundo capitulo señalar las controversias de los nombres de dominio, entre ellas su registro, conflictos, delimitación, las soluciones tradicionales y las aportadas por la ADR al problema y finalmente una breve explicación de ciertas instituciones como ICANN y la UDRP. En el capitulo tercero, se analizaran los reglamentos de solución de controversias de Nic-Chile y Red.es, tomando sus disposiciones generales y especiales para así obtener sus diferencias y similitudes, destacando las particularidades de cada sistema las cuales se verán reflejadas en las conclusiones en el ultimo capitulo de la memoria.

Abstract:

This work tries to make an Analysis between the Mechanisms of Solution of Controversies of names of Existing Dominions on Internet in Chile and Spain. Firstly, ist will deal with the origins of dominion’s names, indicating their operation, nature; distinguishing function and types of dominion names, as well as an historical review of such. Secondly, there is a review of the controversies of dominion names including their registry, conflicts, boundaries, traditional solutions and the ones contributed by the ADR to the problem. Finally, it will be provided a brief explanation on certain institutions as ICANN and UDRP. In the third chapter it will be analyzed the regulations of solution of controversies of NIC-Chile and Red.es, taking into account their general and special dispositions, thus to obtain their differences and similarities, emphasizing the particularities of each system which will be reflected in the conclusions in the last chapter of the thesis.
