La prescripcion de las acciones reparatorias emanadas de los crimenes contra la humanidad

Abstract

La presente Memoria, tiene por objeto principal realizar un análisis de la aplicación que tiene la institución de la prescripción extintiva, respecto a las acciones reparatorias derivadas de los crímenes contra la humanidad. La investigación de esta temática, obedece a que la jurisprudencia nacional se ha mostrado vacilante en torno a aceptar que la imprescriptibilidad de los crímenes contra la humanidad se hace extensiva tanto a la acción civil y penal, que emanan de estos ilícitos internacionales. Por su parte, la doctrina nacional sólo se ha pronunciado en relación a la imprescriptibilidad de la acción penal, por lo cual, en este trabajo, se proponen argumentos para sostener que la acción civil también se excepciona de la prescripción extintiva. Para alcanzar el objetivo, se efectúa un estudio de la reparación, como derecho de las víctimas y como obligación del Estado, frente a la comisión de crímenes de lesa humanidad. ABSTRACT: The following research, has as main objective analyse the application of the institution of the liberative prescription, of the reparation actions with regards to the crimes against humanity. The subject of this research, obeys to the fact that national jurisprudence has been hesitant about accepting that imprescriptibility of the crimes against humanity is extended whether to the civil and criminal action, that comes from this international crimes. In turn, the national academic opinion has only treated the imprescriptibility of the criminal action, and in this research we propose arguments to sustain the civil action is also an exception of the extinctive prescription. In order to achieve the objective, we develop a study of the reparation, as a right of the victims and as an obligation to the State, in the commission of crimes against humanity.
