Las figuras de defraudacion del Codigo Penal Chileno y los sistemas de tratamiento de informacion

Abstract

La presente memoria se fundamenta en la necesidad de otorgar un reconocimiento positivo en nuestro ordenamiento jurídico a hechos ilícitos que tienen como soporte principal la evolución de la informática. Los objetivos principales de nuestra Memoria consisten en acreditar la urgencia de legislar acerca del fraude informático y otras conductas tales como el phishing y sus distintas modalidades, y demostrar que aunque estos hechos tengan similitudes con el delito de estafa, por su especial forma de comisión, no pueden ser subsumidos bajo esta figura; por lo que, a la luz de nuestra actual legislación, podrían quedar impunes. Para la consecución de los objetivos planteados, la investigación propuesta se centra en el análisis de la normativa existente respecto a este tema y de aquellos proyectos de ley que han intentado tipificar estos delitos de nueva generación, además de las opiniones y estudios existentes en esta materia. / ABSTRACT: This report is based on the need to give positive recognition in our legal system to illegal acts that have as their main medium the evolution of computing. The main objetives of the report are to establish the urgency of legislating computer fraud and other behaviors such as phishing and its various forms, and show that although these events share similarities with fraud crimes, because of their special form of commission, they cannot be included under this concept; so, in light of our present legislation, they could go unpunished. To achieve the objectives, the proposed research focuses on the analysis of existing legislation with respect to this issue and those bills that have attempted to classify those crimes from the latest generation, in addition to opinions and existing studies in this area.
