Certificacion academica como elemento de la responsabilidad civil del abogado

Abstract

La enseñanza del Derecho en Chile ha decaído en el tiempo, pues son múltiples las universidades que imparten la carrera y excesiva la cantidad de abogados que se titulan cada año, lo que ha traído como consecuencia que cada vez más abogados, a la hora de la defensa judicial, cometen errores vulnerando la lex artis. Esta investigación señala el proceso de certificación académica de los abogados, desde su ingreso a la universidad hasta el otorgamiento del título profesional por parte de la Corte Suprema, y como esto influye en su errado desempeño profesional, específicamente en la responsabilidad civil que le cabe, en cuanto el cliente confiere mandato judicial al abogado y éste esta obligado a actuar conforme a él. En nuestra legislación no existe norma específica que regule la materia, sin embargo las normas generales pueden dar solución, al hoy impune actuar de la abogacía./ Abstract: The teaching of the Law in Chile has declined over the time, because there are many universities offering the career and it’s excessive the number of lawyers who are entitled each year, which has resulted in more lawyers, that at time of legal defense, make mistakes violating the lex artis. This research marks the formal certification process for lawyers, from their university entrance to the granting of professional titles by the Supreme Court, and how it influences into their poor performance, specifically on their own civil responsibility, when the customer warrant a judicial mandate to the lawyer and he is obliged to act as it order. In our legislation it does not exist a specific order that regulates the matterº, however the general orders can give a solution, for the today’s unpunished acting of the lawyership.
