Analisis sobre la constitucion de servidumbre minera: conflicto con el derecho de propiedad

Abstract

Este trabajo expone un análisis sobre la existencia del artículo 15 del Código de Minería, y 7 de la LOC sobre concesiones mineras, en torno al conflicto de interés que se provoca entre quién desee constituir una Servidumbre minera en un terreno que contenga casas y sus dependencias, o viñedos o arbolados, y el dueño de dicho terreno defendiendo su derecho de propiedad. Esto se hace a través de un estudio histórico-legislativo, además de doctrinario y jurisprudencial. De esta forma, la autora sostiene que el legislador crea estas normas con motivo de tener como antecedente las Ordenanzas de nueva España, las cuales le entregaban una gran protección a la agricultura. Esto se respeta hasta el día de hoy al ser la agricultura una actividad de igual importancia para el desarrollo económico del país, que la minería./ ABSTRACT: This paper presents an analysis of the existence of Article 15 of the Mining Code and Article 7 of the constitutional organic law on mining concessions over the conflict of interest resulting from who wants to be a mining easement in a field that contains homes and outbuildings, or vineyards or trees, and the owner of that land to defend their property rights. This is done through an historical study of legislation, as well as doctrinal and jurisprudential. Thus, the author argues that the legislature creates these rules because of having as antecedent the Ordinances of New Spain, which gave great protection to agriculture. This is respected until today when agricultural activity is as important to the economic development of the country, as the mining activity.
