Analisis de la Ley Nº 20.328 que modifica la Ley N°19.728 sobre seguro obligatorio de cesantia en Chile

Abstract

La presente memoria analiza las modificaciones introducidas al Seguro Obligatorio de Cesantía en Chile, por la Ley N°20.328, que perfecciona el Seguro Obligatorio de Cesantía e introduce cambios a otras normas legales. Es por este motivo que se analiza la Ley N°19.728, que estableció el Seguro Obligatorio de Cesantía en Chile, y de forma pormenorizada la Ley N°20.328, publicada en el Diario Oficial el 30 de enero de 2009. Para la realización de esta investigación, la memoria se divide en dos capítulos, el primero de ellos, trata sobre los aspectos generales del Seguro Obligatorio de Cesantía, como lo es su génesis y evolución. El segundo capítulo, analiza las modificaciones introducidas al Seguro Obligatorio de Cesantía, por la Ley N°20.328, de forma comparativa con su primera regulación en la Ley N°19.728, mencionando brevemente su última modificación mediante la Ley N°20.531, sobre protección al empleo y capacitación laboral./

ABSTRACT: The following thesis analyzes modifications made to Mandatory Unemployment Insurance through Law N°20.328; this law improves Mandatory Unemployment Insurance as well as introduces changes to other legal norms. For this reason Law N°19.728, which established Mandatory Unemployment Insurance in Chile will be analyzed together with a detailed analysis of Law N°20.328, published in the Official Register on the 30th of January 2009. For research purposes this thesis is divided into two chapters, the first chapter discusses general aspects of the Mandatory Unemployment Insurance Law in terms of its origins and evolution. The second chapter analyzes the modifications introduced to Mandatory Unemployment Insurance by Law N°20.328 in comparison to the original version of the regulations, Law N°19.728; this chapter briefly mentions as well the most recent modifications made to regulations through Law N°20.531 dealing with job protection and training.
