Situacion de la autonomia de la voluntad en el regimen economico matrimonial

Abstract

La Doctrina, en forma mayoritaria, ha sentado que las bases del Derecho Civil son la libertad, la buena fe y la autonomía de la voluntad, sin embargo en materia de Derecho de Familia, dado su progresiva constitucionalización, estos principios han sido objeto de limitaciones por las normas de Derecho de Familia que han ido adquiriendo características de normas de orden público. En este contexto importa para esta memoria. determinar la situación en la que se encuentra la autonomía de la voluntad en materia de regimenes matrimoniales consagrados en nuestro Ordenamiento Jurídico, si esta se encuentra consagrada y resguardada de la misma forma que en el Derecho Privado negocial, o por el contrario su manifestación se encuentra limitada. ABSTRACT The legal treatise, mostly, has established that the foundations of Civil Law are the freedom, bona fide and independent judgment, however, in the Family Law given its constitutional guarantee process, this principles have been object of restrictions by rules of Family Law that have become characteristics of rules of public order. In this context, is matter for this thesis, determine the situation of independent judgment in the marital regime established in our Legal System, if is recognized and protected in the same way that in the Private Law, or on the contrary its demonstration is limited.
