Analisis jurisprudencial del tribunal constitucional en materia tributaria, entre los anos 2008 y 2009

Abstract

La presente memoria, titulada “Análisis jurisprudencial del Tribunal Constitucional en materia tributaria, entre los años 2008 y 2009”, tiene como propósito conocer el contenido de las sentencias emanadas de dicho tribunal, con el objetivo de comprender que materias han sido objeto del control de constitucionalidad y categorizar su contenido. Este trabajo de investigación se compone de una síntesis de los pronunciamientos de dicho tribunal, y de sus respectivos fundamentos, para la mejor comprensión y categorización de su contenido. En definitiva conocer lo que ha resuelto el Tribunal Constitucional, y averiguar si los preceptos legales del derecho tributario se someten a la supremacía constitucional, y comprender la evolución y comportamiento de este Tribunal en el ejercicio de estas funciones./ ABSTRACT. The present research titled “Analysis of the Constitutional Court Jurisprudence in taxation matters, between the 2008 and 2009” has as purpose to know the contents of judgments resolved by that court, in order to understand which issues have been checked for constitutionality and categorize their content. This research consists of a summary of the sentences of that court, and their respective foundations, for a better understanding and categorization of his content. In summary, know the ruling of the Constitutional Court and whether the legal provisions of tax law are subject to constitutional supremacy and understand the evolution and behavior of this Court in the exercise of these functions.
