Estudio sobre la organizacion juridica de las asociaciones de canalistas de la cuenca del Rio Mataquito

Abstract

El agua juega un rol estratégico, siendo el eje del desarrollo urbano. Al ser un recurso escaso, con el pasar del tiempo nacieron una serie de instituciones colectivas de acuerdo al derecho, que venían a fiscalizar el uso, organización, gestión y funcionamiento. Éstas, si bien, no abarcaban por completo las necesidades de los regantes, venían a regular por primera vez las situaciones generadas gracias a las prácticas de los usuarios. Sin embargo, la constitución de organizaciones de usuarios y en especial, de asociaciones de canalistas no fue realizada en forma homogénea en el país. Esta investigación verifica los factores que influenciaron a las Asociaciones de Canalistas de la cuenca del río Mataquito, Región del Maule, a constituirse ciñéndose al Código de Aguas, considerando las ventajas y desventajas que se generan al crearse de acuerdo a la legislación existente, realizándose además, un registro de las diversas asociaciones existentes en la cuenca./ ABSTRACT: Water plays a strategic role, being the urban development axis, at being a limited resource, with the passage of time a series of collective institution were born to agree to the right who came to control the use, organization, management and operation. Although these, not cover completely the needs of irrigators, came to regulate for the first time the generated situation thanks to the practice of the users. However, the constitutions of organizations users and specially, from associations of channel users that was not performed in a homogeneous form in the country. This investigation checks the factors that influenced in the association of channel users of the basin in the river Mataquito, 7th region to constitute encircling to the Código de Aguas, considering the advantage an disadvantage that are created to the agreement of legislation already existed, besides, realizing a record of the diverse existing associations in the basin.
