Efectividad de las sanciones establecidas dentro del marco de la nueva ley de responsabilidad penal juvenil

Abstract

La presente memoria está orientada básicamente al estudio de la nueva normativa aplicable en el Ordenamiento Jurídico Chileno en lo que respecta al Derecho Penal Juvenil, siendo ícono de esta materia, la Ley 20.084, que crea un sistema de Responsabilidad Penal para Adolescentes infractores a partir del año 2007. Así, se tendrá como directriz este cuerpo normativo, teniendo especial énfasis en las consecuencias jurídicas que el legislador prevé para los adolescentes, determinando las deficiencias y problemas que ellas presentan en relación a los principios inspiradores de la Convención Internacional sobre Derechos del Niño.Los resultados esperados son: poder determinar cuáles son las sanciones que el legislador establece para los menores en el texto normativo de la Ley 20.084 y si se diferencian al sistema aplicable a los adultos; determinar cuáles son los organismos encargados del cumplimiento de ellas y por último criticar la efectividad o no efectividad de las mismas./ ABSTRACT: This research is basically oriented to the study of the new Chilean legislation about Juvenile Criminal Law, being the Law number 20.084 an icon in this subject, creating a criminal responsibility system for teenagers offenders since the year 2007. In this manner, we will have this law as guideline, emphasizing on the legal consequences that the Legislator has anticipated for the teenagers, establishing the deficiencies and troubles related with the inspiring principles of the International Convention on the Rights of the Child. The expected results are: being able to determine which are the sanctions that the Legislator establishes for the children in the law number 20.084 and if they are different from the system applicable for the adults; to determine which ones are the organizations in charge of their observance and at last, criticizing their effectiveness.
