Title: El servicio nacional de menores en Chile, su funcion de proteccion amparada en la constitucion y el dereho internacional, versus su funcion sancionatoria contenida en el derecho penal adolescente

Abstract: De acuerdo a las normas legales internacionales sobre derechos del niño, los sistemas de justicia juvenil, deben crearse como regímenes especiales, diferentes al derecho penal de adultos. En el contexto Chileno, la Ley 20.084 pretende hacerse cargo de la implementación de aquellas normas, que digan relación con la sanción impuesta a los menores que delinquen y a su vez la protección de sus derechos, como seres humanos y como niños. Para lo cual se crea una institución especializada, conocida como el Servicio Nacional de Menores, que tiene en sus manos la difícil tarea de sancionar y rehabilitar a los niños, niñas y adolescentes víctimas y victimarios. Es por lo dicho que mediante esta Memoria, se pretende conocer la normativa nacional contenida en dicha ley y en los tratados internacionales ratificados por Chile y vigentes, para conocer la función crucial que adquiere el Servicio Nacional de Menores dentro del sistema normativo vigente./ ABSTRACT: According to the international laws about children's rights, the juvenile justice systems should be created as special regimes, different from the criminal law for adults. In the Chilean reality, the law number 20.084 aims to take responsibility for the implementation of those laws, related with the sanctions given to the children who commit a crime or an offense, and at the same time, with the protection of their rights, as human beings and as children. For this it has been created a specialized institution called National Service for the Children, that is in charge of the hard task of sanctioning and rehabilitate boys, girls and teenagers who have been victims and offenders. It is for this that this research aims to know the national regulation content in this law and in the international agreements ratified by Chile and in force to know the crucial function that the National Service of Children has in the current law system.
