Análisis jurisprudencial del Tribunal Constitucional en materia tributaria años 2006 - 2007

Abstract

La presente Memoria realiza un análisis jurisprudencial del Tribunal Constitucional de Chile respecto de las sentencias vinculadas a materias tributarias emitidas en los años 2006 y 2007. La vía más óptima para la consecución satisfactoria de dicho análisis es la de una investigación jurídico dogmática, de tipo exploratoria. De este modo, se estudiarán las resoluciones en particular y se tratarán los temas tributarios que éstas contienen para luego obtener las conclusiones correspondientes, guiándose esencialmente por la ley y por determinados autores. Esta investigación jurídica en forma de Memoria tiene como objetivos principales conocer, comprender, analizar, sintetizar y evaluar la jurisprudencia y, asimismo, definir si existe, o no, uniformidad en el criterio para resolver los casos por parte del Tribunal./ ABSTRCT: This Report takes a jurisprudential analysis of the Constitutional Court of Chile on the judgments whose content is related to tax matters, which were issued during the years 2006 and 2007. The most optimal way for the successful achievement of this analysis is that of a dogmatic legal research, exploratory. Thus, decisions will be studied in particular and will address the tax issues they contain and then obtain the relevant conclusions, guided primarily by law and by certain authors. This legal research in the form of memory is primarily aimed to know, understand, analyze and synthesize the case and also define whether or not there is, uniformity in the approach to solve cases by the Court.
