El Femicidio en el ordenamiento jurídico chileno

Abstract

El Femicidio en el ordenamiento jurídico chileno” es un trabajo que tiene por objetivo investigar el tratamiento penal de esta nueva figura delictiva especial. En el primer capítulo se entregan nociones básicas, para entender el femicidio. De la lectura del segundo apartado, se comprenderá cuál es y fue la situación de esté fenómeno en Chile. En el acápite número tres se analiza la necesidad existente de incriminar al femicidio cómo un fenómeno social identificable, viendo su autonomía respecto a las tradicionales formas de sanción penal. La sección número cuatro muestra la interacción que se produce entre el nuevo delito y otros, como el homicidio y el parricidio, además de la relación que hay con la ley de violencia intrafamiliar. Por último, se estudiarán los resultados obtenidos por esta modificación y su injerencia en el cumplimiento de la Convención Interamericana para prevenir, sancionar y erradicar la violencia contra la mujer./Abstract: "The Femicide in the Chilean law" is a work that aims to investigate the criminal treatment of this figure new delictive special. In the first chapter provides basic knowledge to understand the femicide. From reading the aloof second, understand what is and was the situation of this phenomenon in Chile. In the section number three discusses the need existent of incriminate the femicide identifiable as a social phenomenon, seeing its autonomy from the traditional forms of criminal punishment. The section to number four show the interaction that occurs between the new offense and others, such as homicide and parricide, besides the relationship with the domestic violence law. Finally, we will study the results obtained by this modification and its interference in the implementation of the Convention on the Prevention, Punishment and Eradication of Violence against Women.
