Principales modificaciones introducidas por la Ley Nº 20.286 a la Ley Nº 19.968, que crea los tribunales de familia

Abstract

La Ley Nº 19.968, que crea los Tribunales de Familia, modernizó el procedimiento aplicado a las materias relativas al “núcleo fundamental de la sociedad”. Sin embargo, al poco tiempo de su entrada en vigencia, debió someterse a modificaciones, por cuanto surgieron inconvenientes que obstaculizaron el cumplimiento de los objetivos de esta nueva justicia, que son, principalmente, el acceso a una justicia especializada, inmediatez entre el juez y el usuario, privilegiando las soluciones colaborativas entre las partes, instaurando instancias previas a la sede judicial para ello. Conocer las características principales de este nuevo procedimiento de Familia, las causas que determinaron la necesidad que fuera modificada, los cambios introducidos por la Ley Nº 20.286 y leyes anteriores y el estado actual del sistema de Familia luego de las modificaciones efectuadas, son los objetivos de esta Memoria, analizando para ello, las fuentes legales y su historia, además de bibliografía especializada al respecto./ABSTRACT:Law Nº 19.968, which creates the Family Courts, modernized the procedure applied to matters relating to the “fundamental core of society”. However, soon after its entry into force, had to undergo modifications, because problems arose that hampered the implementation of the objectives of this new justice, which are mainly, access to a specialized justice, immediacy between judge and user, privileging collaborative solutions among parts, establishing pre instances the courts for this. Knowing the main features of this new procedure of Family, the causes that determined the need to be modified, the changes introduced by Law Nº 20.286 and previous laws and the current status of the Family System after modifications, are the targets of this Memoria, analyzing for that, the legal sources and its history, plus literature specialized about it.
